Petite Progress Privacy Policy

Petite Progress is a brand owned and operated by Home And Tower Life LLC (“Home And Tower Life,” “we,” “us,” or “our”). This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you use Petite Progress websites, mobile apps, and related services that link to this Privacy Policy (collectively, the “Services”).

Important note (please read): Photo printing requires you to upload images to the internet. No online system can be guaranteed 100% secure. If you do not want an image stored on internet-connected systems—even temporarily—do not upload it.


1) What This Policy Covers

This Privacy Policy covers information we process when you:

  • Visit or use our Services;

  • Create an account;

  • Upload photos or other content;

  • Create projects (albums, prints, calendars, cards, etc.);

  • Place an order;

  • Contact customer support;

  • Subscribe to marketing communications; or

  • Otherwise interact with us.

This Privacy Policy does not cover third-party websites, apps, or services that may be linked from our Services (including social platforms, payment providers, shipping carriers, or analytics tools). Those third parties have their own privacy policies and practices.


2) Definitions

For clarity, we use these terms:

  • “Personal Information”: information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to you or your household (definitions vary by jurisdiction).

  • “Photo Content” / “User Content”: photos, images, text, captions, designs, projects, and other content you upload or create through the Services, including associated file metadata (e.g., file name, size, format).

  • “Vendors” / “Service Providers” / “Processors”: third parties we engage to help operate the Services (e.g., cloud hosting, printing production, shipping, payment processing, customer support, analytics, fraud prevention).


3) Information We Collect

A) Information you provide

When you use the Services, you may provide:

  • Account information: name, email address, password, phone number, login credentials.

  • Order and fulfillment information: billing and shipping address, recipient address (if shipping to someone else), order history, and order preferences.

  • Payment information: payment card information or other payment details.

    • Note: Payments are typically processed by third-party payment processors. We generally do not store full card numbers; we may store limited payment-related information such as payment tokens, transaction IDs, and billing details as needed for accounting, refunds, fraud prevention, and customer support.

  • Customer support communications: messages, emails, chat transcripts, recordings (if you call us and a call is recorded), and related details you choose to share.

  • Marketing preferences: email/SMS preferences and consent records where applicable.

B) Photo Content and project data (specific to photo printing)

To provide a photo printing service, we collect and process:

  • Uploaded photos/images and any content you add (captions, text overlays, layouts, designs).

  • Project data: edits, crops, print sizes, templates, recipients, and other instructions required to produce your order.

  • File metadata: file type, file size, and technical identifiers needed to process and print.

  • Embedded metadata: some photos may contain EXIF data (like device type, date/time, and sometimes location). You can remove EXIF metadata before uploading if you prefer.

C) Information collected automatically

When you use the Services, we and our Vendors may automatically collect:

  • Device and browser data: device type, operating system, browser type, language settings.

  • Log data: IP address, access times, pages viewed, links clicked, referring/exit pages.

  • Cookie and tracking data: cookies, pixels, SDKs, and similar technologies, used for essential site functions, analytics, and (where applicable) marketing.

D) Information from third parties

We may receive information from:

  • Payment processors (e.g., payment confirmation, fraud indicators);

  • Shipping carriers (delivery status and address validation);

  • Fraud and security partners (risk scores or signals);

  • Marketing/analytics partners (aggregated or device-level data depending on configuration and your choices).


4) How We Use Information

We use information for the following business purposes:

A) To provide and operate the Services (including printing and delivery)

  • Create and manage your account

  • Process orders and payments

  • Produce prints and photo products

  • Deliver orders and provide delivery updates

  • Provide customer support and handle returns/refunds

  • Provide reprint support and resolve order issues

B) To communicate with you

  • Order confirmations and shipping notifications

  • Service-related messages (policy changes, security notices, product updates)

  • Customer support responses

C) To improve, secure, and maintain the Services

  • Debug, troubleshoot, and maintain performance

  • Monitor for misuse, fraud, and abuse

  • Protect against spam, malware, and security threats

  • Conduct internal analytics to improve features and user experience

D) For marketing (subject to your choices and applicable law)

  • Send promotional emails/SMS if you opted in or where permitted

  • Provide offers, discounts, and updates

E) Legal and compliance

5) How We Share Information

We do not sell your Photo Content. We do not publish your photos publicly or use them in marketing without your explicit permission.

We may share information in the following limited circumstances:

A) With Vendors who help us run the business

We share Personal Information and/or Photo Content with Vendors as needed to provide the Services, such as:

  • Print production partners (to manufacture your photo prints/products)

  • Shipping and logistics providers (to deliver your order)

  • Cloud hosting and storage providers (to store projects/photos and operate the platform)

  • Payment processors (to process transactions and prevent fraud)

  • Customer support tools (to assist with support tickets and communication)

  • Security and fraud prevention providers (to protect against malicious activity)

  • Analytics providers (to understand and improve how the Services are used)

These Vendors are authorized to use information only as necessary to provide services to us and are typically required by contract to protect it.

B) Within our corporate family

We may share information within Home And Tower Life LLC and its affiliated brands, subsidiaries, or entities under common control for legitimate business purposes such as security, fraud prevention, centralized operations, analytics, and customer support.

C) Legal, safety, and enforcement

We may disclose information if we believe it is necessary to:

  • Comply with law, legal process, or lawful requests

  • Protect the rights, safety, and property of Home And Tower Life LLC, Petite Progress, our users, or others

  • Investigate fraud, abuse, and security incidents

  • Enforce our terms and policies

D) Business transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction.

E) With your direction or consent

For example, if you ship an order to a gift recipient, we share the recipient’s address and shipping details with carriers and fulfillment partners.


6) Photo Content Rules, Access Controls, and “No Publication / No Sale” Commitment

A) We do not sell or publish your photos

  • We do not sell Photo Content to data brokers, advertisers, or other third parties.

  • We do not publicly display or publish Photo Content unless you clearly and affirmatively consent (for example, if you voluntarily submit a testimonial and explicitly authorize use of a specific photo).

B) Limited access for fulfillment and support

To print and deliver products, Photo Content may be accessed by:

  • Automated systems that process images for printing (formatting, resizing, color adjustments, print-ready generation); and

  • Authorized personnel and Vendors only when necessary to fulfill orders, provide customer support, handle quality issues, investigate abuse, or meet legal obligations.

C) Prohibited content and cooperation with authorities

You agree not to upload Photo Content that is illegal, abusive, exploitative, or violates others’ rights (including intellectual property and privacy rights).

  • We may remove content, suspend accounts, refuse orders, and/or report to appropriate authorities when required or appropriate (including for suspected child sexual abuse material and other illegal content).


7) Data Retention and Deletion (Photos Are Not Instantly Erased)

A) Retention for printing operations and support

Because this is a photo printing service, we do not instantly erase photos. We retain Photo Content and project files for as long as reasonably necessary to:

  • Fulfill and ship your order;

  • Support reprints, returns, refunds, chargebacks, and customer service;

  • Maintain account/project features you choose to use;

  • Detect and prevent fraud or misuse;

  • Comply with legal obligations and enforce our rights.

B) Deletion requests

You may request deletion of your account data and/or Photo Content by contacting us (see “Contact Us” below).

  • We may need to verify your identity before honoring certain requests.

  • We may retain certain information where required or permitted by law (e.g., tax, accounting, fraud prevention, dispute resolution).

  • Backups: Even after deletion, content may persist for a limited period in encrypted backups or logs for disaster recovery, security, and integrity purposes, and will be removed or overwritten in accordance with our backup lifecycle.

C) You should keep your own backups

You are responsible for maintaining your own copies of Photo Content. We do not guarantee that Photo Content will be recoverable after deletion, account closure, or service changes.


8) Information Security and Risk Allocation (Very Important)

A) Our security approach

We use administrative, technical, and physical safeguards intended to protect information, which may include access controls, encryption in transit, encryption at rest (in some systems), monitoring, and vendor security reviews.

B) No guarantee of security

Despite our efforts, no method of transmission over the Internet and no method of storage is completely secure. You understand and agree that:

  • You use the Services at your own risk;

  • Your Photo Content and Personal Information may be targeted by unauthorized third parties;

  • We cannot guarantee that hackers, malware, viruses, security incidents, or unauthorized access will never occur.

C) Limitation of responsibility for cyber incidents

To the maximum extent permitted by applicable law, Home And Tower Life LLC and Petite Progress:

  • Disclaim responsibility and liability for unauthorized access, hacking, malware, viruses, denial-of-service attacks, and other security incidents that are outside our reasonable control or that occur despite reasonable safeguards; and

  • Are not liable for damages arising from such incidents, including loss of data, loss of profits, reputational harm, or emotional distress.

Nothing in this Policy is intended to waive rights or remedies that cannot be waived under applicable law (for example, certain statutory rights related to certain types of data breaches).

D) Your responsibilities

You are responsible for:

  • Keeping your password confidential

  • Using secure devices and networks

  • Maintaining updated antivirus/anti-malware protections

  • Not uploading files that contain malware or harmful code


9) Cookies, Analytics, and Advertising

We use cookies and similar technologies for:

  • Essential functions (site security, shopping cart, login)

  • Performance and analytics (understanding how the Services are used)

  • Marketing (where permitted and based on your preferences)

You can usually control cookies through your browser settings. Disabling cookies may affect how the Services function.

Do Not Track

Some browsers offer “Do Not Track” signals. The Services may not respond to all DNT signals. However, where required by law, we honor legally recognized opt-out preference signals (for example, certain global privacy controls).


10) Your Privacy Choices

Depending on your location and how you use the Services, you may have the ability to:

  • Opt out of promotional emails via the “unsubscribe” link

  • Adjust cookie settings in your browser

  • Request access, deletion, or correction of certain Personal Information

Authorized agents: Where allowed, you may use an authorized agent to submit requests on your behalf, subject to verification and proof of authorization.


12) EU/UK/International Users

If you access the Services from outside the United States, you understand your information may be transferred to and processed in the United States and other countries where we or our Vendors operate. Data protection laws may differ from those in your jurisdiction.

Where EU/UK data protection laws apply, you may have additional rights and we may rely on legal bases such as contract performance, legitimate interests, consent (where required), and compliance with legal obligations.


13) Children’s Privacy

The Services are not intended for children under 13. We do not knowingly collect Personal Information from children under 13. If you believe a child has provided Personal Information to us, contact us and we will take appropriate steps consistent with applicable law.


14) Dispute Resolution, Arbitration, and Waivers

To the maximum extent permitted by law, you and we agree that disputes relating to privacy, data, or the Services will be resolved through binding arbitration rather than in court, and you waive the right to a jury trial and to participate in class actions, except where such waivers are prohibited by law.

No personal liability of owners/shareholders/individuals: To the maximum extent permitted by law, you agree that any claim must be brought against Home And Tower Life LLC as an entity only, and not against any of its shareholders, members, managers, directors, officers, employees, contractors, agents, or representatives in their personal capacity.

(If you already have Terms of Use for Petite Progress, the arbitration/class action language should match those Terms to avoid conflicts.)


15) Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The “Last Updated & Effective” date at the top indicates when this Policy was last revised. Your continued use of the Services after an update means you accept the updated Policy, to the extent permitted by law.
